Terms $ Condition

1. The Booking

Your contract is with Motion Travels Pvt. Ltd. A contract exists between us when we have confirmed you on our tour of your choice and we have received your signed booking form/email confirmation and deposits. The confirmation also confirms that you and other people on the tour accept our booking terms and condition and are entering into the contract.

2. Deposit

Upon completion of the signed booking form a deposit of 30% of the tour cost per person, be paid to Motion Travels Private Limited. The deposit is required to hold the booking on confirmed basis.

3. Payment

All payments can be made to us by cash, cheque, Demand Draft (payable at New Delhi) or electronic money transfer. For booking which are made within 15 working days of tour departure, the full amount will become immediately payable.

Note:

All payments should be free and clear of any withholding tax and deduction. Bank charges, if any, for remittance (by remitting bank or by intermediary bank) would be strictly borne by payer.

Once the completed booking form and deposit has been received an invoice will be sent, along with a receipt for the amount already paid. The balance of the payment must be paid 21 days prior to the tour departure. Any booking made within 21 working days of the tour departure is considered to be late booking for which the full and final payment is required at the same time of booking. Failure to pay the balance within the specified period will result in the cancellation of the booking, and in payment of a cancellation fee as detailed below.

Note:

Apart from above, in case of bookings for special train journeys, hotel or resort bookings during the peak season, full payment is required to be made at the time of booking itself.

5. If you cancel your Holiday

If you or any member of your party wishes to cancel your holiday, you must notify us in writing, in any case the date of cancellation will be at the date on which notice is received in the Tours Department of Motion Travels Pvt. Ltd. The person who signed the booking form must also sign the letter of cancellation. As this incurs administrative cost and retention charges by hotel and other parties, the cancellation charges will apply on the following scale:

Please note -

Irrespective of above mentioned cancellations slabs – in case of cancellation of tour / travel services after the booking is made with us - a minimum 25% service charges would be applicable.

In case you cancel the trip after commencement, the refund would be restricted to a limited amount that too would depend on the amount that we would be able to recover from the hoteliers we patronize. For unused hotel accommodation, chartered transportation and missed meals etc. we do not bear any responsibility to refund.

For high peak season bookings (from 20th Dec to 15th Jan) - please note that if the booking for high peak season is/are cancelled, due to whatsoever reason, no refund would be made for said cancellation.

Refund

In regard to refund of unused / unutilized services (which are paid for and cancelled in advance) the refund amount would be worked out on the basis of cancellation policy as described above and the money would be accordingly refunded to the person who has made the payment to us. Please note that the refund process may take 2 - 4 weeks due to banking procedures. If the refund is made to Bank account, the bank charges would be debited from the refund amount.

6. If you change the booking

If, after your confirmation invoice has been issued, you wish to change your travel arrangement in any way, for your chosen departure date or accommodation, we will do utmost to make these changes, but it may not always be possible.

7. Liability

The company does not own or control hotels, coach or other facilities mentioned in the tour. As an operator of the package tour therefore, we cannot be held liable.

  1. Where there has been no fault on the part of the company, supplier or agents.
  2. Where the failures in performance of the contract are attributable to the customer.
  3. Where the failures are attributable to a third party not connected with the provision of the holiday and are unforeseeable or unavoidable.
  4. Where the failures are due to unusual and unforeseeable circumstances beyond your control.
  5. Where the failures are due to an event which you or your supplier even with all due care could not foresee or foretell.

We do take all reasonable steps in ensuring that the organisation maintains standards and provide a service that is acceptable to the passengers. The information within this website has been compiled with all reasonable care and is correct to the best knowledge of the company and is published in good faith.

8. Complaints

pWe do our best to give passengers travelling on any of our holidays, an enjoyable and trouble free holiday but occasionally plans go wrong. Should you have any complaint, please tell your Motion Travels Manger at the time, who will do everything possible to resolve the matter immediately. If the situation is not resolved to your satisfaction, then you must notify the company within 28 days of the tour ending in writing. If you do not write to us within this time, this will affect the investigation and outcome of the complaint. Any disputes between clients and Motion Travels Pvt. Ltd. shall be governed by Jurisdiction of New Delhi, India.

9. Passports & Visas

To travel to India from overseas countries except for the citizen of Nepal & Bhutan, one needs a 06 months valid passport and a valid Visa. And processing of Passport and Visa shall bear supplementary charges. The VISA allotment is relative to each individual is entirely at the discretion of the respective embassy. Motion Travels Private Limited cannot be held liable in VISA issues.

10. Health

Any person who has a contagious disease is forbidden to travel, any person found during the tour with such a disease will be asked to leave the tour and will have to make their own arrangements to return home.

11. Early Check-in / Late Check –out

Check-In Timings: 1200 - 1500 Hours Check-Out Timings: 1000 - 1200 Hours

Please note that standard check-in / Checkout time (IST) in good hotels are mentioned above. Therefore cost of early check-in or late check-out is not included in the tour cost. We can always make a request for early check-in or late checkout if required but we do not guarantee that, it entirely depend upon the policy of the hotel, time of the year and availability of the room.

12. Extra Uses of our Vehicle

Please note that cost of the vehicle (car / coaches with the driver) is not included in the tour cost like usage of vehicle after transfer or sightseeing until or unless it is mentioned in the itinerary.

13. Rights to amend the itinerary if required

Motion Travels Private Limited - itineraries are sample itineraries, intended to give you a general idea of the likely trip schedule. Numerous factors such as weather, road conditions, the physical ability of the participants etc. may dictate itinerary changes either before the tour or while on the trail. Motion Travels Private Limited reserves the right to amend any aspect of the itinerary including transportation and accommodation without notice in the interest of the trip, participantschr(32) safety, comfort and general well being without making any rebate, allowance or refund and extra cost, if any, would be payable by the client.

14. Surcharge

The Price of your travel arrangement is subject to surcharges in case of sudden hike in fuel prices, schedule airfare and any taxes levied by the government. Even in this case, we will try to absorb an amount of 2%, amount exceeding over 2% will be surcharged.

15. Our Liability

Motion Travels Private Limited rates are based on the prevailing rates as negotiated by us with the hotels, airlines etc. Hotels and Airlines retain the right to modify the rates without notice. In case of such change - the rates quoted by us before modification can be changed by us according to the modifications by hotels or airlines.

Motion Travels Private Limited and its associates acts only in the capacity of an agent for the hotels, airlines, transporters, railways & the contractors providing other services & all exchange orders, receipts, contracts & tickets issued by us - are issued subject to terms & conditions under which these services are provided by them. The tickets, coupons or passage contract in use by carrier / hotel or other contractors rendering services shall constitute the sole contract between the Clients and such contractor.

Motion Travels Private Limited shall not be responsible for any delay or change in programme or expenses incurred or special / consequential loss, injury and damage - directly or indirectly - due to natural hazards, flight cancellations, accident, breakdown of machinery or equipments, breakdown of transport, weather, sickness, landslides, political closures, acts of God, perils incident to the sea, floods, fire, acts of Government or any other authorities, wars, civil disturbances, riots, theft, pilferage, epidemics, quarantines, medical or custom department regulations, defaults, or any other causes beyond our control or any untoward incidents or any such causes whatsoever including any liability or extra expenses sustained by the Clients. Further, the Clients shall be liable for the liability or extra expenses incurred by him / her as a result of the forgoing causes.

Motion Travels Private Limitedshall not be responsible and shall not accept any liability towards the Clients or his/her legal representative for any loss of property or damages resulting from death or injuries including loss of services which the Clients may sustain on account of act, negligence or default by any transportation Company, hotel agents or any other body of persons, its agents or service providers providing such services or facilities or arising out of or while engaged in any tour, means of transportation or other services, whether due to ownership, maintenance , use, operation or control of any automobile, bicycle, boat, motor, or other vehicle in common carrier or otherwise and whether due to its or there negligence or otherwise or regardless of how caused. Clients using sporting equipment, bicycles, sailing boats, scuba diving gear, hired or supplied by hotels or rental bodies shall do so at their own risk.

Motion Travels Private Limited - do not have any insurance policy covering the expenses for accident, sickness, loss due to theft, or any other reasons. Visitors are advised to seek such insurance arrangements in their home country. All baggage & personal property/s at all times are at the clients risk.

Motion Travels Private Limited reserves the right to cancel any services in case it deems that the tour, trip or passage is impracticable, any reason or should circumstances warrant such action, upon refunding the value thereof and the Client shall not have any other or further claim against the company by any reason thereof.
